Gov puts schools in crosshairs to leverage support for tax increase

House GOP says governor’s threat to cut schools unnecessary; ample money in 2010 budget to shore up School Aid Fund

House Republicans today called on Governor Jennifer Granholm to stop playing politics with Michigan’s public schools by using them as unwilling pawns in her high-stakes chess game to wrest more taxes from struggling families and job providers, adding that the state can cover an estimated $264 million hole in the School Aid Fund with money currently in the 2010 budget.

The Republican call came in response to the governor’s drastic $127 per pupil funding cuts.

“We can solve this problem with the money we have in the budget, without raising taxes, and that is what House Republicans propose to do,” said House Republican Leader Kevin Elsenheimer. “Since the beginning of the budget discussions, the governor has been looking for a way to force a tax increase. Now she’s joined the budget discussion at the eleventh hour, doing her best to blow away a bipartisan agreement to balance the budget without a tax increase.”

Added state Rep. Phil Pavlov, R-St. Clair, the ranking Republican on the House Education Committee: “Education funding has always been a top House Republican priority. All along, we’ve had a plan that funds education and balances the budget without raising taxes – and we can put this prudent action into motion today. Michigan families and job providers simply can’t afford another job-killing tax increase.”

Elsenheimer noted that the Legislature presented the governor with a balanced, bipartisan budget for her consideration.

“The Legislature put a balanced budget on the governor’s desk. Clearly she’s using fear mongering to set the stage for her tax increases,” Elsenheimer said. “It was the governor’s choice – not the Legislature’s – to veto funding for select schools and then implement additional painful cuts.

“House Republicans have a reform plan that focuses on those things state government must do – the things government is constitutionally required to do – and funding K-12 public education is one of them.”

This isn’t “Summer of my German Soldier”. These aren’t people who can be assimilated into our society and become “citizens” without issues of their potential to commit terrorism on US soil being addressed first. Whether or not the Gitmo detainees are actual enemy combatants doesn’t matter, they are potentially the enemy of the US and as such have no right to the same rights as legal, law abiding US citizens.

“Allowing detention without trial creates a dangerous loophole in our justice system that mimics the Bush administration’s abusive approach to fighting terrorism,” Kenneth Roth, executive director of Human Rights Watch

In the Geneva Convention articles regarding POWs, there are no conditions that give prisoners the same rights as the people of the country they are being held by (Geneva Convention relative to the Treatment of Prisoners of War, 75 U.N.T.S. 135, entered into force Oct. 21, 1950). This is only allowed if the country holding POWs allows it.

Chapter III

PENAL AND DISCIPLINARY SANCTIONS
Article 84

A prisoner of war shall be tried only by a military court, unless the existing laws of the Detaining Power expressly permit the civil courts to try a member of the armed forces of the Detaining Power in respect of the particular offence alleged to have been committed by the prisoner of war.

In no circumstances whatever shall a prisoner of war be tried by a court of any kind which does not offer the essential guarantees of independence and impartiality as generally recognized, and, in particular, the procedure of which does not afford the accused the rights and means of defence provided for in Article 105.

Nor does the Geneva Convention state that POWs have to be released or assimilated into the country that is holding them captive.

PART IV

TERMINATION OF CAPTIVITY

SECTION I

DIRECT REPATRIATION AND ACCOMMODATION IN NEUTRAL COUNTRIES
Article 109

Subject to the provisions of the third paragraph of this Article, Parties to the conflict are bound to send back to their own country, regardless of number or rank, seriously wounded and seriously sick prisoners of war, after having cared for them until they are fit to travel, in accordance with the first paragraph of the following Article.

Throughout the duration of hostilities, Parties to the conflict shall endeavour, with the cooperation of the neutral Powers concerned, to make arrangements for the accommodation in neutral countries of the sick and wounded prisoners of war referred to in the second paragraph of the following Article. They may, in addition, conclude agreements with a view to the direct repatriation or internment in a neutral country of able-bodied prisoners of war who have undergone a long period of captivity.

No sick or injured prisoner of war who is eligible for repatriation under the first paragraph of this Article, may be repatriated against his will during hostilities.

RELEASE AND REPATRIATION OF PRISONERS OF WAR AT THE CLOSE OF HOSTILITIES
Article 118

Prisoners of war shall be released and repatriated without delay after the cessation of active hostilities.

In the absence of stipulations to the above effect in any agreement concluded between the Parties to the conflict with a view to the cessation of hostilities, or failing any such agreement, each of the Detaining Powers shall itself establish and execute without delay a plan of repatriation in conformity with the principle laid down in the foregoing paragraph.

In either case, the measures adopted shall be brought to the knowledge of the prisoners of war.

The costs of repatriation of prisoners of war shall in all cases be equitably apportioned between the Detaining Power and the Power on which the prisoners depend. This apportionment shall be carried out on the following basis:

(a) If the two Powers are contigu ou s , the Power on wh ich the prisoners of war depend shall bear the costs of repatriation from the frontiers of the Detaining Power.

(b) If the two Powers are not contiguous, the Detaining Power shall bear the costs of transport of prisoners of war over its own territory as far as its frontier or its port of embarkation nearest to the territory of the Power on which the prisoners of war depend. The Parties concerned shall agree between themselves as to the equitable apportionment of the remaining costs of the repatriation. The conclusion of this agreement shall in no circumstances justify any delay in the repatriation of the prisoners of war.
Article 119

Repatriation shall be effected in conditions similar to those laid down in Articles 46 to 48 inclusive of the present Convention for the transfer of prisoners of war, having regard to the provisions of Article 118 and to those of the following paragraphs.

On repatriation, any articles of value impounded from prisoners of war under Article 18, and any foreign currency which has not been converted into the currency of the Detaining Power, shall be restored to them. Articles of value and foreign currency which, for any reason whatever, are not restored to prisoners of war on repatriation, shall be despatched to the Information Bureau set up under Article 122.

Prisoners of war shall be allowed to take with them their personal effects, and any correspondence and parcels which have arrived for them. The weight of such baggage may be limited, if the conditions of repatriation so require, to what each prisoner can reasonably carry. Each prisoner shall in all cases be authorized to carry at least twenty-five kilograms.

The other personal effects of the repatriated prisoner shall be left in the charge of the Detaining Power which shall have them forwarded to him as soon as it has concluded an agreement to this effect, regulating the conditions of transport and the payment of the costs involved, with the Power on which the prisoner depends.

Prisoners of war against whom criminal proceedings for an indictable offence are pending may be detained until the end of such proceedings, and, if necessary, until the completion of the punishment. The same shall apply to, prisoners of war already convicted for an indictable offence.

Parties to the conflict shall communicate to each other the names of any prisoners of war who are detained until the end of the proceedings or until punishment has been completed.

By agreement between the Parties to the conflict, commissions shall be established for the purpose of searching for dispersed prisoners of war and of assuring their repatriation with the least possible delay.

It seems that bleeding heart liberal politicians and lawmakers want to treat enemy combatants, especially Islamic Jihad terrorists, as poor misguided souls who had no choice to do what they did because the Great and Evil USA made them become terrorists and enemy combatants. Maybe with open and welcome arms these wayward prodigal sons can be reformed, no matter that many released detainees from Gitmo have already returned to terrorism (Pentagon: Some released Gitmo detainees return to battle).

It would be irresponsible of our lawmakers to not only house detainees in the US, but give them the same access to our courts and our rights too. This dereliction of duty by those who represent us gives preference to our enemies over “we the people” and our rights. We will also be forced to house, feed, and represent these combatants at the taxpayer’s expense, despite that the majority of the people do not want Gitmo detainees on US soil and the House voted against bringing them here (House votes against bringing Gitmo detainees to US). There are also security issues to be addressed. But no matter what the negative issues are, President Obama is still determined to bring the Gitmo detainees to the US (Obama: Bring Guantánamo detainees to US, detain some indefinitely).

The idiocy of the current White House Administration just proves over and again that Barack Obama and his underlings have no respect for the wishes of the people of this republic.

Hang on. ObamaCare, if it passes, is going to cost you plenty. This is madness to say the least. It is optional, everybody should have it, it will only cover 94% of Americans, not 100%, not including illegals, but if you don’t want it, you are still going to have to pay either a penalty if you have no insurance, or a 40% tax on your insurance premium if you want to keep your current insurance that you are totally happy with.

Speaking at a town hall meeting near the shores of Lake Pontchartrain, Obama recounted what he said was “good progress” during the first nine months of his administration. But he was quickly put on the defensive by one resident who said he was still frustrated by the slow pace of the economic and physical recovery around him.

Obama: We get results?. Obama gets the Nobel Peace Prize for doing absolutely nothing. In fact, his whole current term as President so far has been full of getting nothing done. No new jobs, no improving economy, but hey, he has gone around the world to apologize that America exists and has liberties and tries to defend liberty around the world, so I guess he has accomplished 1 thing so far. Better than Michigan Governor Jennifer Granholm.

Perhaps he should go on another apology tour, only this time in the US and apologize to America for apologizing for America. Then he needs to make the Democrats remove the Health Care bill and Cap & Trade. This would be a start. Oh, and he needs to apologize for Michelle being such an America hater too.

The Federal Government is as terrible at creating jobs as Michigan Governor Jennifer Granholm is. Both keep making promises to put thousands of people to work by using taxpayer money, but the job promises never come to fruition. All the people ever wind up getting from these hollow promises are emptier wallets.

Now the White House and manufacturing czar, Ron Bloom, says that they will “boost” the manufacturing sector at a later date.

“Whether it will be through new legislative initiatives, etc., I assume there will be. But I am not going to wait for that. I think if we can do some of what we are doing better…we can make a genuine impact much more quickly.”

Sounds to me like he has no idea what he is going to do yet. One of the areas he wants to concentrate on is “green collar” jobs in the auto industry and concentrate on solar, wind, and electric vehicles. Sounds like he is taking his que from Governor Jennifer Granholm, who’s push for green jobs since her election to Michigan Governor has brought naught in the way of thousands of these so called “green” jobs.

As I have stated in the past, the Federal Government needs to remove it’s hands from the jobs “deal” it wants to create. Instead, the government, and Michigan (Michigan has shed 25 percent of its manufacturing jobs since Jan. 1) needs to remove the tax burden and ineffective and inefficient state and federal regulations from businesses and allow businesses to grow themselves. Let companies have more money so that they can invest in themselves and their products and create new jobs at their own pace. In the jobs market, “Build it and they will come,” doesn’t work when government thinks that more taxes and regulations actually create jobs. Instead, jobs are lost when businesses are stifled by government interference.

Rep. Betty Sutton, D-Ohio, said the administration “needs a comprehensive vision for building manufacturing in this country again. We have to be a country that makes things,” Sutton said, calling it a “national security issue.” The problem is, none of the things the government does to create new jobs are even close to a “comprehensive vision.” All one has to do is look at how the Federal Government is run financially and see why it’s constant talk about job creation in nothing but talk. Government just can’t run anything without going into the red.

To add to Michigan’s debacle, Governor Granholm wants to place a 3% tax on Michigan’s doctors (Tax Michigan Doctors–they are rich and don’t behave). With jobs still being lost in Michigan, this is a terrible idea. Michigan’s latest unemployment figures show the state’s unemployment is up again (Michigan Unemployment Increases To 15.3%, Granholm Set To Lose 1 Million Jobs By End Of Term. Detroit Free Press Says GOOD NEWS!) and the governor wants to keep raising taxes. If this doesn’t reveal that government has no clue how to create a friendly work environment, what will wake people up and make them stop the government from spending money on frivilous ideas that only deepens the debt of the State of Michigan and the United States of America?

Government needs to keep it’s paws off and let the private business sector take care of itself.

I’m shocked at this morning’s news regarding the Detroit Public Schools.

1,545 DPS employees were carrying ineligible dependents on their district health care plans.

How did this level of corruption get so far for so long? Who has been sleeping at the wheel? Somebody, besides the guilty, needs to be punished for this unacceptable level of unscrupulous deceit. Detroit Public Schools Emergency Financial Manager Robert Bobb is just as stunned as the rest of us and promises to cut off the offenders. It was bad enough that in August, 411 people were ineligible, some who were dead, but this just makes it even worse. Bobb expects that DPS will save around $2.6 million dollars by cutting off the offenders.

It seems that the school employees are more interested in filling their own wallets with money rather the heads of their students with an education. It is no wonder then that DPS has the worst drop out and graduation rate in the nation. Only 1 in 4 students graduate from DPS. That’s right, only 1 in 4 graduate!

The district has arrested at least 20 people in the last three weeks for stealing $150,000 worth of goods from the schools.

This is just the people they have caught. If over 1,500 employees are guilty of fraud, how many are guilty of stealing? The coming months will probably reveal even more people involved in theft from DPS and the students. This is such as shame that so many employees care so little for the education of those who are entrusted to their care.

But the bad news continues,

Evicted three community groups that leased space for their organizations but stopped paying rent or did not transfer utilities out of DPS’ name. The district collected $462,000 from other delinquent leaseholders.

Ceased payments to a national insurance company for covering grandfathered employees that the company could not name.

Fired a company that was negotiating $5 million to $6 million a year from Medicaid when the district is eligible for at least $60 million.

Plan to fire at least 30 security officers who refuse to come to work.

Informed unions that DPS plans to end full health care benefits for part-time employees. “We have employees who are earning $8,000 a year, and we’re paying somewhere between $13,000 and $14,000 a year for their medical costs.”

With this amount of fraud and corruption, it is no wonder DPS is so far in debt and cannot graduate it’s students. Hopefully Mr. Bobb will continue his efforts to uncover fraud and theft as he says he will. So far it seems he is keeping his word and hopefully he can turn the DPS around, but it will be a long haul for him. He seems to have the integrity DPS needs and appears to be a true leader who is not afraid to dig in and get to the dirt that is the norm for DPS.
